New Mexico’s Gun Waiting Period Law Upheld by Federal Judge

A federal judge has ruled in favor of New Mexico, allowing the state to enforce its new seven-day Mexico's Gun Waiting Period on gun sales.

The decision comes amidst a legal challenge brought by the National Rifle Association (NRA).

Judge Rejects NRA Challenge

U.S. District Court Judge James Browning, in Albuquerque, rejected the NRA's request for a temporary restraining order or injunction to block the waiting period.

The law, enacted earlier this year by Democratic lawmakers, aims to give authorities more time to complete background checks on gun buyers.

"The defendants provide substantial evidence that waiting period laws may help reduce gun violence," stated Judge Browning in his lengthy ruling.

Governor Praises Decision, Citing Safety Benefits

Governor Michelle Lujan Grisham applauded the decision, calling it a confirmation of the waiting period's constitutionality.

"This cooling-off period enhances public safety by preventing impulsive gun purchases and ensuring thorough background checks," she said.

Lawsuit Filed by Gun Rights Groups

The NRA, along with the Mountain States Legal Foundation, filed the lawsuit on behalf of two New Mexico residents.

They expressed concerns about the law potentially delaying access to firearms for victims of domestic violence.

Notably, the Supreme Court recently upheld a federal law restricting gun ownership for domestic abusers.

Case to Proceed, Supreme Court Consideration Possible

Robert Welsh, representing the Mountain States Legal Foundation, acknowledged the case can continue with further evidence being presented. He also highlighted the growing trend of state-level waiting periods.

"The Supreme Court will likely need to address these waiting period laws eventually," Welsh stated.

New Mexico’s Waiting Period Now in Effect

New Mexico's waiting period, which exempts concealed carry permit holders, has been in effect since May 2024.
